JURY – OB-GYN Not Negligent in Bend Ovary-Removal Case

Bend, Ore.- After a week of testimony and about two hours of deliberations, a Deschutes County jury Wednesday, rejected a lawsuit filed by a Bend woman, accusing her surgeon of removing the wrong ovary.

Shelly Morton said she went into surgery in October 2011 to have her right ovary removed.

Instead, Dr. James Carlson removed the left ovary.

Dr. Carlson claimed he did so because he realized during surgery the pathology of the left ovary indicated it was the unhealthy one, not the right.

Ms. Morton sued Dr. Carlson for $850,000.

In the end, the jury did not find the evidence convincing.
