Federal Judge Strikes Down Same-Sex Marriage Ban in Indiana

iStockphoto/Thinkstock(INDIANAPOLIS) — A federal judge struck down Indiana’s ban on same-sex marriage on Wednesday, saying it violated due process and equal protection under the Fourteenth Amendment.

The ruling came in response to three same-sex marriage lawsuits that had been brought before U.S. District Judge Richard Young earlier this year. Ken Falk, the legal director for the American Civil Liberties Union of Indiana, said he was “ecstatic,” and that “there is simply no justification for treating same-sex couples any different than other loving couples of opposite genders.”

ABC’s Indianapolis affiliate, RTV6, reports that Indiana Attorney General Greg Zoeller plans to appeal the ruling and request an emergency stay to halt same-sex marriages until a final decision.
